These Terms of Service ("Terms") govern your access to and use of the Exceed Learning Center website at www.exceedlearningcenterny.com, including our program pages, registration and payment forms, and the staff tools available to our administrators (together, the "Services"). Please read them carefully.
1. Acceptance of These Terms
By accessing our website, submitting a registration or inquiry form, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.
If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf.
2. Our Services
Exceed Learning Center provides educational programs including tutoring, test preparation, enrichment courses, workshops, clubs, and camps, delivered in person at our Albertson, New York location and, where indicated, online. Our website describes these programs and allows you to inquire about or register for them.
Program descriptions, schedules, instructors, and pricing shown on the website are provided for information and may change. We make reasonable efforts to keep the website accurate and current, but we do not warrant that every detail is free of errors or omissions.
3. Registration and Enrollment
When you register for a program through our website, you agree that:
- The information you provide is accurate, current, and complete, including the student’s name and the contact details of a parent or guardian where the student is a minor
- You are authorized to register the student named in the form
- We may contact you by phone, email, or text message about that registration
- A registration is a request for a place in a program and is confirmed only once we have acknowledged it and any required payment or deposit has been received
We reserve the right to decline or cancel a registration, and to reschedule or cancel a program, including where enrollment is insufficient or circumstances beyond our reasonable control require it.
4. Fees, Payments, and Refunds
Fees, deposits, and any discounts are those stated on the relevant program page or registration form at the time you register. Payment methods accepted are shown during registration and may include Zelle, card, or cash.
Where a program page or registration form states that a deposit or fee is non-refundable, or sets out a cancellation deadline or refund schedule, those terms apply to that program. If a program is cancelled by Exceed Learning Center, you may choose a transfer to another available program or a refund of amounts paid for the cancelled sessions. For any question about a payment, deposit, cancellation, or refund, please contact us using the details in Section 12.
5. Acceptable Use of the Website
You agree not to:
- Submit false, misleading, or fraudulent information, or register on behalf of someone without their authorization
- Submit automated, repeated, or bulk form submissions, or attempt to bypass any security check on our forms
- Attempt to gain unauthorized access to our administrator dashboard, databases, accounts, or any part of the Services not intended for you
- Probe, scan, or test the vulnerability of our systems, or interfere with their normal operation
- Upload anything containing malicious code, or any content that is unlawful, harassing, or infringes the rights of others
- Copy, scrape, or republish substantial portions of our website content for commercial purposes without our written permission
6. Staff Accounts and Google Calendar Integration
Our administrator dashboard is restricted to authorized Exceed Learning Center staff. Access is granted by invitation to specific email addresses and is not available to the public. If you hold staff access, you are responsible for keeping your email account secure and for all activity carried out under your access.
Staff may optionally connect a Google account so that class and session schedules can be managed alongside our calendar. That integration, the Google permissions it requests, how the resulting data is stored, and how to disconnect it are described in Section 5 of our Privacy Policy. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
7. Intellectual Property
The website and its contents, including text, course materials, graphics, logos, photographs, and the Exceed Learning Center name and marks, are owned by Exceed Learning Center or used with permission, and are protected by copyright, trademark, and other laws. You may view and print pages for your own personal, non-commercial use in connection with our programs. Any other use requires our prior written consent.
8. Content You Submit
You retain ownership of the information and materials you submit to us, such as form responses, notes, and payment references or screenshots. By submitting them, you grant us permission to store and use them for the purpose of processing your registration, providing our programs, and keeping our own records. You confirm that you have the right to submit what you send and that it does not infringe the rights of any third party.
9. Third-Party Services and Links
The Services rely on third-party providers, including our hosting, database, email delivery, bot-protection, scheduling, and calendar providers, and our website may link to or embed third-party content such as maps, videos, and booking tools. We do not control those services and are not responsible for their content, availability, or practices. Your use of a third-party service is governed by that provider’s own terms and privacy policy.
10. Disclaimers and Limitation of Liability
The website is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or secure against every possible threat. While we describe our programs honestly, we do not guarantee any particular academic result, score, admission, or other outcome from participation.
To the fullest extent permitted by law, Exceed Learning Center will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website. Nothing in these Terms limits any liability that cannot be limited under applicable law. These website Terms do not replace or reduce any separate agreement, waiver, or enrollment document you sign with us for a specific program.
11. Changes to These Terms
We may update these Terms from time to time. We will indicate any change by updating the "Last updated" date at the top of this page. Your continued use of the Services after a change takes effect constitutes acceptance of the updated Terms. These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
